    Here is how. It is called the Oil Pollution Act of 1990


    1002(d) Provides that if a responsible party can establish that the removal costs and damages resulting from an incident were caused solely by an act or omission by a third party, the third party will be held liable for such costs and damages.

    1004 The liability for tank vessels larger than 3,000 gross tons is increased to $1,200 per gross ton or $10 million, whichever is greater. Responsible parties at onshore facilities and deepwater ports are liable for up to $350 millon per spill; holders of leases or permits for offshore facilities, except deepwater ports, are liable for up to $75 million per spill, plus removal costs. The Federal government has the authority to adjust, by regulation, the $350 million liability limit established for onshore facilities.

    There is the concern of JUST WHAt HAPPENS after the gobules have fallen to the floors of the marsh,estuaries,bayous and lakes to be eaten by the shrimp . Then of course the birds who call the area a rest stop while migrating, and the fish who will eat this. They have already restricted large oyster leases As someone who knows his way around an oyster, shrimp boats as well as a pirogue, this is bad...:(
    It will end up every one of the thousands of inlets and settle in the marsh,on marsh grass-killing it.

    I hope we don't veer that way.:)

    Well they seem to be stepping up to the plate. They are responsible for EVERYTHING!!!!! The "blow out preventer valve" you are hearing so much about was actually contracted out to -guess....... HALIBURTON.... they same nice folks who are responsible for the Timor well blowout off Austrailia. BP also leased the "Horizon" and it's workers. They don't "own" the rig.
    My uncle has spent a lot of time on that rig (he's a crane operator), as well as many others in the Gulf ( did you know there are over 30,000????), and he's finding it very strange(as am I) that no rescued workers have made 1 public statement. None to the paper. None to the news channels. Hell, there hasn't been ANY FIRST PERSON ACCOUNT OF WHAT HAPPENED TO ANYONE AT ANY tIME!!!!! That's just weird....:idea2: :confused:

    I hope this thread doesn't turn. I've been waching all the channels today (I'm off) and EVERY national channel has it sort of -well wrong. I saw our Gov., head of the Coast Guard and BP guy all live and our local channels are the best source. After the entire day of listening to this, I'll save more stuff for later.... :sleep:

    Seriously, this looks very grim. I just read this and it is not very promising. My wifes relatives are shrimpers out of New Port Richey,Fla. and they are out of business as of today.

    On another note, oil at 30,000 feet below the surface. Sort of proves that crude oil is abiotic and not from dead dinosaurs and ancient vegetation. Since I was a teenager , I had a feeling that oil was a lot more than dead dinosaurs. The Russians are drilling 40,000 ft on land.

    If they do not get that thing stopped it will be the worst desaster in the history of this country. I cannot believe there are not better ideas to stop it. How about juts dumping tons of sand and gravel on top of it?? How about high exposives to rupture the line???? I cannot believe I can come up with ideas and the best they can come up with is drill a new wel that takes 90 days. This could mean the end of a lot of how we live and everyone just points the finger at BP. Just get it corked,

    This just plain sucks. Safety equipment was installed and tested regularly. 2 days before this if I recall correctly. This may just be a freak accident or they think that the top of the well (underwater part) was poured incorrectly and it failed. They're pointing fingers at Haliburton. We may never know what caused the safety systems to fail. The optional sonic valves (required in other countries) false often and close causing the rig to shut down. They operate with something similar to a sonar ping.

    I hope for everyone's sake that this gets controlled quickly.

    My other worry is that even if BP get's fined, the cost of this clean up could bankrupt them. Then nobody pays the bill but us, the tax-payers.

    This will be one of the biggest disasters the world has known when it's all said and done. BP has a fund to pay for this with a cap of 75 million for lawsuits. After that amount, we will pay. We are probably going to pay right off the bat with rising gas/oil prices. This will not fix the gushing oil from the bottom of the Gulf. It will be months before they can try to do anything to plug the leak, if at all.

    Isn't it amazing that BP drilled a couple thousand feet down into the earth and did not have a plan to stop the oil flow an case something went wrong??? It's like flying an airplane and forgetting that you needed landing gear once your in the air!

    Oh well on the flip side I got my 55 gallon drums ready to ship out to the refinery as I could use some 110 octane for my car.:Brow: I also won't have to worry about the tourists crowding the roads here anymore.

    They have a plan---it's called the Blowout Preventer. These are part of the wellhead assembly when drilling any oil and gas well (subsea or not) and they contain a series of "stops" or rams to shut off well flow in the event of an accident. If the well blew out outside of the well casing, then it's another matter as the BOP function would be useless in that event.

    My bet is they have a plan but like all plans, something inevitably crops up to make them completely useless.

    In no way do I mean to denigrate or downplay what is happening here or make excuses for BP, but the way the media is spinning it, they want you to think these guys were a bunch of amateurs or Jed Clampits shooting holes in the ground to see what would come up.

    I read a book a while back (can't remember the name) and it talked about "complex systems" and how things tend to go awry, regardless of all the failsafe measures designed into the system. The book talked about the Three Mile Island accident and other accidents and showed how the "interconnectiveness" of these complex systems makes them ripe for failures.

    Offshore drilling is an EXTREMELY complex endeavor and it's pretty much inevitable that things like this will happen from time to time. Again, you can put all the failsafe measures in the process you want but it still happens.

    BP won't go bankrupt with this accident....more hype. They have EXTREMELY deep pockets and they'll have to empty them a bit for this disaster. Bankruptcy, however.....ain't going to happen.

    From what I have also read what is sad is the state of the wetlands area along the Gulf Coast with the damage done by hurricanes, lack of new sediment flow due to levee construction further up the Mississippi (prevents renewal of the sediments that help build up the wetlands/marsh areas), and all the fertilizer that accumulates in those areas from upstream farm operations. This is the same "wetlands" area that they said would have served as a decent buffer when Katrina hit had they been larger and in better shape.

    Also...this is the General Hangout Section...."Buick related" isn't a requirement.

    The costs to the livelehoods of those making their livings along the coast is sad indeed.


    "Progress" has a price and we are paying for it....again.

    They have insurance. Lots of insurance. When you generate the kind of profits the oil companies do, expenses are not a concern.

    Well they're gonna try to place a box over it to pump the lighter crude out. It has taken days to build this. They still don't know if it will work at this depth and this situation. Why these boxes are not pre staged along the coast causes me concern.

    I believe their cap is much higher than that Ted, but will need to look at the last few papers. There also has been a bill passed recently that raised the cap. Ultimately, they will be responsible for the expenses. IF they go under-well the big bosses will be looking for work. Unfortunately they will put thousands out of work as well.

    Thousands of fishers across S. LA and MS volunteered to help more than a week ago. They were rebuffed. Now I don't know if it is a PR move, but they now have them under better contract for their services laying out boom and working the places the families have fished forever.

    That's like saying you won't drive a Buick because you heard one crashed.

    IMHO, BP isn't to blame from a negligence perspective, because their liability is so high it would never be worth it, but they surely are responsible... but we shall see.

    he is right...I lived in southcentral Alaska before, during and after the Exxon Valdez oil spill. It sucks that oil was spilled........ however, it isnt the end of the world. Prince William sound recovered almost completely within just a couple years. And now you cant find any sign that the spill ever happened. .

    You must have missed my post where I pointed out that my Riv uses Castrol oil made by Bp and burns a substance called "gasoline" also made by them that my car uses to make go-go.:idea2:
    If I were face to face at any meet as I will be in a couple of weeks, and all we discussed were the cars, I would be bored. At the point I ask my friends about their health and the kids and the dog and the latest movie and their favorite "ball club" and other esoteric convo that normal folks do.
    This ,all of course, I'm sure would have you hissing at us while backing slowly away-fingers made into a "cross" looking for the nearest cam grind panel for the remainder of the day. And I wish you great luck in that regard!:TU:
