    So let me try and make sence of all this, :idea2: the winning bidder has refused to buy your car because it is to cheap:Dou: so I guess if he feels so bad about the price he should cut you a check for say $140,000, that should make him feel better:Do No: I'm sorry but you held a no reserve auction and you have NOT 1 but 2 bidders $100 apart from each other $81,400 and $81,300 if either one of these bidders intended to buy your car it would be gone. Lets face it I'm sure the second bidder would shoot you the extra $100 to seal the deal. I will quote you ( Why would anyone sell a frame-off numbers matching yellow 4 speed GSX for 81K? That would just kill the value of these cars for everyone else that has one):spank: This is called manipulating the market, for a legit no reserve auction to take place car and money would have to change hands, NO ONE forced you to have a no reserve acution. I think this kind of bidding should be reported to e-bay.Mean while you guys are sitting there with your BIG dollar resto's telling everyone how much your cars are worth not how much someone will pay you for them...........Chris

    eBay Seller Non-Performance Policy

    When a seller lists an item on eBay, and a buyer bids for and wins that item, the seller and buyer have entered into a contract that both members are expected to honor.

    In addition to the above rules, here are some additional policy violations not permitted on eBay:
    Seller Non-performance Sellers must honor the transaction contract. Sellers cannot fail to deliver an item for which payment was accepted, significantly misrepresent an item by not meeting the terms and item description outlined in the listing, or refuse to accept payment for an item at the end of a successful sale.

    If the Buyer agrees not to purchase for the otherwise agreed ending auction price and terms, the Seller will ultimately have a defense to opt out of the deal for non-performance.

    The REAL question is whether there was ANY prior agreement between the Seller and Buyer to create this "fail safe" non-sale result if the price did not end up high enough on this "no reserve auction" format... quid pro quo, gentlemen. What a sham(e).

    I know this type of bidding goes on in E-Bay auctions. I believe the car I bought, had a couple of repected board members doing the E-bay hokie pokie. But heck, I'm happy with what I got at what I paid. I know if I would have been the high bidder on any car I though was a bargain.....sale over!

    What the H*LL? This was a NO RESERVE AUCTION. The response about "... kill[ing] the value of these cars ..." has NOTHING to do with the voluntary selection of a NO RESERVE AUCTION and the issues being discussed about possible bidding collusion.

    Advice: Use the RESERVE function so everyone bidding or considering bidding has proper notice of the conditions of the sale so their time and effort are not wasted ... and then live by your agreement. Shame on someone.

    Sorry to get of topic but Is that your car in the avatar? If so is there any pic's posted on the board? Thats a very nice looking car.I saved a pic from e-bay, I love this car!....Chris

    Sounds to me like the "buyer" and seller came to an agreement about the deal, so if they are both OK about it why should anybody elses ASS be chapped???? Go ahead, flame away on me, I have broad shoulders. :moonu: I mean--who really gives a sh!t, its his car he can do whatever the hell he wants with it.:TU: :TU:

    mike I agree with you....Its his car and the deal was between him and the potential buyer. Why are people running around in womens pantys over this?:bla:

    ... because the fix was in on this before the gavel fell on the auction ... and, it's an abuse of the selling system to say one thing (no reserve) and then have a hidden way out of a deal ... and because probably a few laws may have been broken if it could be proven ... and potentially Federal laws at that since it involved transmission over state lines ... and personal integrity ... and ... man, if you don't get the picture by now...

    It's better to have it all out in the open and know where people stand on this stuff.

    By the way, if it does not bother you, then how do YOU tell the difference between a real "NO RESERVE" auction and a "JUST KIDDING NO RESERVE AUCTION"? Inquiring minds want to know ...

    It gets better and better, I just got a threatening pm from the BPG web site from trim code 188 (Henry White) What a classy guy, I wish I could post it here just so people could see this pm. John I'm not judging or roasting you I just think you made a mistake by not putting a reserve on it to protect your investment. When I seen this auction come up with a no reserve and John doing it I didn't expect this out come. Chris

    I'd be pretty upset if I was 5vees. As far as I'm concerned, the market spoke loud and clear as to what that GSX is worth right now, even if it is lower than expected. Nothing personal, just hard number facts right now

    So who pays the fees to ebay for the listing since it officially sold in the eyes of ebay??

    The fact of the matter is that several days after the auction ended, 5 vees contacted me and I found out who he was and that I knew him. AND, he told me that this caught him off-guard and he would never have believed that he would be high bidder, so he would need time to move money around. He and I agreed in several conversations since that we could move forward or leave it be. Either way is fine with both of us. Chris, had you or anybody else been high bidder, I would absolutely honored the agreement. I think everyone here knows me and knows that is true. If the buyer and seller work out their own arrangements to their satisfaction, wonderful.

    Glad it worked out in the end (?), but just one question...why in the world would someone in a situation like that ever bid to begin with??????

    I'm glad I've never had to deal with a bidder behaving like this.

    I am going to bet even if there was a 500 buy it now that a certain no name person wouldn't be able to afford that either.

    If you got game buy the car, if you don't stay on the sidelines with the cheerleaders and S.T.F.U.

    Sorry if the comments are pointedly direct to the heart of the issue and that it seems to make you uncomfortable, but I think this has been exposed for what it was even if you did not think it would be found out or was harmless.

    I care about the truth. And, you will have to pardon me if the overwhelming circumstantial evidence points in the same direction which seems to be contrary to your statements.

    I remember so many other people being upset because of others asking "tough" questions. My experience is that when someone doesn't like "tough" questions ... keep asking them. Didn't Bill Clinton get upset exclaiming others were "causing trouble" asking tough and direct question about Monica?

    By the way, I have plenty of other things to do .... unfortunatley, my day job is catching blue & white collar criminals, not Sellers in private eBay auctions, per se. I just did not expect to find this sort of thing here of all places.

    Feel free to send me a private email, though, let's not burden others w/ personal accusations so they can enjoy this board for their hobby.
