Spoke briefly again with Brian yesterday..........he was prompt as promised on a return contact call time.......sounds like things are heading in the right direction between us......currently working on putting what we verbally have agreed to into writing. Hoping that closure and follow-through are only days away now.

    Will keep you all posted.

    Tim,

    any update?

In any case, I think we can assume that Earick Racing Engines, Inc., if it ever was a true "incorporated" establishment, is effectively "out of business," true?

I just hope it can be resolved amicably.

Brian has now been in touch with me on a somewhat timely basis and his phone calls reflect he is attempting to do something about the situation I was concerned about.............at this point however........it is just his WORD that things are progressing. I have NOT seen anything YET in the mail or "hard-copy" that Brian said he was going to do.......I will give this some more time to get completed since he claims he is working with another party to get this resolved.........but it is a "short stick" I am leaning on. Patience is thin at this point before I just proceed with my initial plans.........but I still have some patience left...........I just hope it does not get to the point AGAIN I have to give a "FINAL DATE" to get things unstuck.......because what is negotiated now will be thrown out the window along with my sliver of trust I am giving Brian at this point.

On a good note.............my 1970 GSX is running stronger than EVER before with the rebuild and tuning it received in Fort Wayne, Indiana.......It's a MONSTER!!! :3gears: :3gears: :3gears:

    Tim,

I sincerely hope everything gets resolved to your satisfaction, but I totally agree with your statement that "it should never have taken this long" to get things straightened out.

Although I am no attorney, I have had my share of dealings with them (though I have never been sued, fortunately), and I guess I don't understand Brian's need to confer with his attorney and/or involve "third parties."

In my opinion, you have stated he already spoke with the machine shop that corrected his work (though you never even gave him the name/number), and has reviewed the paid receipts that you have provided him.

I never hire an attorney (at $250-$350/hour) unless absolutely necessary.

I must say that I don't see the need for Brian to do so. Seems like he should have admitted his mistakes and compensated your for your time and trouble--months ago.

    No third parties/attorneys need, IMHO.

    Just my $0.02. Good Luck!

    Cheers,

    Ranger

Hi Ranger, things may be going slower than people want for many reasons. Just because somebody makes a claim for substandard work (their opinion) doesn't entitle them to the defendant's check book. I would confer with an attorney to determine if i could be held liable. If i'm liable, the next question is how much liability. Then comes $$$. Will it cost more to go to court than to settle out? Perhaps.I was once named in a lawsuit for 500k. I did not have that kind of money laying around. End result, my insurance comp.coughed up 2k & said have a nice day. The End. It took 2 years to get to that point. I learned a lot from that experience. (patience) I have cleaned out an ex-wife through divorce & took my ex back to gain more custody & won. One note referring to Brian Earick, his invoices state " no warranty implied or expressed" I don't know legally if that will hold water, again let the professionals sort it out. Wishing good luck to the parties involved. Randy

    Randy,

Thanks for your reply. You make some valid points. Bottom line is: the court system is fricked up, and one never wants to get involved with lawyers, courts, etc., if it can be avoided. It's almost a joke at times, really (remember O.J.?)

Anyway, as I am getting ready to install my Bulldogs, please e-mail me, as I would like to get your experience with them, porting them, or whatever you did with them. Or, you could post this info to the forum, although we are now straying from the original topic. Your call. You cold even initiate a new post about the Bulldogs, though it may be moot, since they probably will never again be produced. I think it was a fairly good design, with some problems on the exhaust side, plus finsih quality issues, and it's too bad about Bradshaw's antics with these heads and with the block.

    Regards,

    Ranger

A lot of time has gone by and you have not updated the Board about your dealings with Earick.

I hope your silence is a good thing and that things have been completely resolved in a fair and amicable manner.

I wish everyone a nice and safe Labor Day.

    Regards,

    Ranger
