Very interesting, if it was recorded on an old school VHS it would be available for future family members and fun at family gatherings and nobody's the wiser. But putting it on youtube is like sending out invitations to your trial to the whole world. LOL People just don't realize that your private account is public.

I would hire a different litigator. Wouldn't "racing" need to be defined as trying to win? Is anything over the speed limit "racing"? There was no other competition to "win". I think the video can be great evidence but the state would require a LOT of experts. To verify this video. Where was the evidence that this was actually on a North Carolina highway? I didn't get the license plate number or even color of that car as it passed, let alone did I see the driver. Obviously two different people providing video. Was the video inside the car, the same car that passed the other video? I think a good attorney could pick the arrest apart! It is going to cost a lot of money but the state has the original post as evidence.
I know nothing of the legal rules that apply to this case. What I do know is that it is the certainty of punishment - not the severity of it, is the deterrent. Obviously if this kid is proven guilty there should be a significant punishment - a five-year license suspension, a $5,000 fine, and probation for five years comes to mind, but confiscating the car and serious jail time are only going to create a bitter, barely employable person. The statute of limitations is up, but in a state other then my legal residence now, I once made a very high speed pass through a measured mile. Looking back, it was a stupid thing to do, but when you are 23 you are invulnerable and an expert on everything. If I had been caught and (basically) crucified legally, I would not have had the career that I did, I would not have spent the money that I did (which helped create paychecks for others), and would not have paid the taxes that I did. How would that have made the country better?
It's not his fault. The car should have had a warning label on the dash stating that it is illegal to drive above the posted speed limit. He should be exonerated of all charges and given a trophy for not injuring or killing anybody. Then Dodge should recall all of their cars to add the warning sticker. They should then be forced to make educational commercials stating that it can be dangerous to drive at high speed.
So Flyn . If I pisted myself doing 90 on a 65. I coukd get a ticket? Whose to say its real? And spectators dont have radar guns documenting speed like a hwy patrol man does when giving you a ticket. The most the cops can do is use the video for location referance and try to catch them in tbe act. All the guy has to do is contest and have the aresting officer show up in court. Wats tbe prosecutor gona say. Yes we gave a u tube video and tbe spedometer says 198. But we didnt actually see this or have it on radar or lydar. I have to disagree.
I was born and grew up in N.C. and thae have had a few laws that I felt were over the top, if I went to the drag strip as a spectator if you didn't remove your tag the HP would rid through the PARKING LOT write down tag # and notify insurance Co. that you were drag racing and your insurance would be canceled. Got a ticket doing 80 in 55, licenses suspended for 6 months, had to turn in my license to the clerk of court or spend 10 days in jail, state then suspended my PRIVILEGE for 6 months. I moved to FL shortly after that in 1964, I only return to visit now.

So everyone that had a GS or GSX or any other fast car (list goes on) back in the day did exactly the speed limit. We all ran the **** out of the cars. We just didn't document it, because it wasn't possible at the time.

I'm still driving ancient junk so I 'll ask.. Is it possible the on board electronics could verify time speed and gps distance from sat nav ? The same with video evidence placing him at scene and mark off distance and time in video as corroborated evidence ?
More reason to not drive a so called smart car. So a Hell Cat will do 198.mph. I know to just let one of them pass me by now. The kid must have seen the cop come to his door and crumbled. If he had any smarts we wouldnt even be hearing about this.

For sure, an EDR could be programmed to be triggered at a certain speed or by extended periods of acceleration. And then, there is your personal cell phone information. The first court date is September 4, 2018. Generally, defense counsel will ask for a continuance. However, if the Hellcat is still impounded, this would cast some doubt over whether the defense will ask for a continuance. In light of the publicity this case has received, there is a serious issue about whether an assistant DA will be allowed to accept any pleas to lesser included offenses, like spontaneous speed competition. I predict the head DA may not allow a plea if she feels good about their evidence on the initial charges.
