Ticket Update

    Well I went to court for my reckless operation on private property.
    Turns out a reckless op is a a reckless op NO MATTER where it is at or who says you can do it. I consulted a lawyer about it, and she pretty much said you can be ticketed for doing a burnout in your own driveway. SO my private property plea was shot down in flames ever before I went into court. So my options now are: Plea not guilty and get a lawyer to represent me in a later court date, or plea no contest and hope the judge cuts you a break. We I thought it over and it is no different to plea no contest than it is pleaing not guilty and representing myself in court. I really dont have to money to waste on a lawyer that quoted me at least 600 plus expenses plus lose another day of work going to court. So, plead no contest in hope that the judge would work with me. He pulled my case and the cop didnt even write a statement, so he asked me what happened. I told him the story and was truthful about everything. He then called a continuance to review my driving record. I'm thinking, that its clean cause I have never had a ticket and the peeling and squealing ticket I got back when I was 17 is cleared due to a diversion course I took. So he calls me back and he then asked me what I did to upset the fairfield county judge. Well I guess even though my license is clean he can still see every little detail on the record. Well that was the fork in the potato, I'm done. Guilty, 154 dollars in fines and 4 points on the license. Right now I'm just hoping the insurance company doesnt find out for awhile. What gets me is that a lady a few cases infront of me caused a crash that put a family of 4 in the hospital and was issued a reckless operation. They only difference between her and my case was she got a license suspension for 30 days with an exception to nessecities and she had a lawyer present from the law firm she worked at anyway.

    The only thing that the court screwed up on was a waiver of rights when you plea no contest. Well the state prosecuter is supposed to pick up your plea and give you a paper. Well he was talking to the deputy and I never got the paper. So now I can petion the court and pull my plea. At this point, whats the difference, I could sit here and complain about the system, but it will do no good. Just gonna take it where the sun dont shine and leave my car sit until I move to a different county at the end of the month.

    Until then, let the smoke roll in Salem... I stopped by the speed shop on the way to work from court and bought me a new set of MT ET streets to cheer myself up.

    So why arnt cops at drag strips writing tickets for burn outs and speeding??? You would have plenty of examples to prove your point.

    Its a lame cop out that lawyer gave you, they sound lazy. I know a guy who can get you off on anything for $200 each time he shows up. I got out of murder compared to your ticket.

    lawyer always told me to plead not guilty and let it go to trial. Most time the prosecutor will make a better deal with you then the judge can legally do as they don't want to trial out most traffic crap. Also other people will judge your easier then a Judge will if it does go to trial.

    Especially for BS traffic crap.

    i got a wreckless op. ticket when i was about 19, i went to the mayors court and explained what happened and it was reduced to a "without due regard"(whatever the heck that is) but it was only 2 points and the ins. co. didnt raise my rates.

    all i did was chirp the tires and the rent-a cop on a bike got me!!:spank:

    Did you point out that no one was put in danger in anyway by your actions?

    The results suck but at least you still have your license. The "even if it was on private property" is so bs that I bet they were amazed you didn't call them on it! Like it was said by Buick_350X, why aren't they at the drag strips ticketing away? Or how about the airport, those big planes smoke the tires everytime they come down!

    Yeah I did explain it was right when the store closed and the parking lot was clear. But that didnt seem to matter, they dont care. They give you a break the first go around and you keep getting tickets, the crack down on you. It's just a repetitive process. There is no explaining or reasoning. There is no processing what you say. You did it once (even though it was dropped) so now I'm gonna pay for it. Guilty... next case. My hemroids itch, this dress is giving me swamp @ss, and I have a whole pile of probation cases to get through before lunch.

    I asked the lawyer about what the law stated, and she pretty much said the law is written to be interpreted, so its up to the judge to take it how he likes.

    Never heard that one. My truck got hit in a private parking lot in VA 2 years back. I called the VA Hwy Patrol which promptly showed up. The girl driving the other car that hit me and myself approached the cop and he told us there was nothing he could do. Sheriff's office or patrol office had no power over private property. So he gave us a paper to write eachother's info. down on and said to let the insurance company handle it. I am almost 100% sure that TN is the same way. Strange law. Like stated above, why not just show up at a dragway and write tickets??????

    It is really kind of dumb. Would you get a ticket for riding a dirt bike in on your own property, peeling out doing a wheelie???

    My girlfriend's sister has been to court three times for traffic stuff and pleaded not guilty. As long as the cop doesn't show up in court they can only listen to you. She managed to get out every time. Makes me wonder.....

    Yes, most times you will get off or can make a deal if you plea not guilty.

    As the judge must follow the law if you plea anything else. Only thing he can do most times is give you a brake on court cost or suspend your jail term. With inactive probation and community service.


    They can only make a deal and do what they think is right and ignore what the laws say if you plea not guilty.

    Most courts just want your money. They will make a deal with no points if they don't think you did much wrong.
