Help, anybody know William Dybowski from Texas?

    Does anyone know William Dybowski? I sold him an evenfire intake for his V6 Buick on eBay and he claims it is damaged. Not only that, he has reversed his payment in Paypal so now I have a negative balance. The jerk (trying to be nice) didn't even send my intake back! Paypal is totally taking his side and I'm left with nothing! Could someone on this board please help? I'm not looking for his scalp in a box (or maybe I am) but I just wanted to see if anyone in the area knows him. Maybe talk to him. Maybe get my intake back! I'm hurting for money as it is and this Buick renegade has really made things worse for me.

  2. I didn't know it was possible to "reverse" a paypal payment, once sent. Do you mean that Paypal reversed it, based on his damage claims?

    How did you ship it? Did you insure the shipment? Except for really inexpensive items, I always use UPS which has I believe $100 insurance included as std on each shipment.

    I'm really baffled on this reversed payment situation. Please explain how that was done. Sorry to hear of the problems, what kind of damage is claimed? Did he provide photos? What is the amount of the transaction?

    I bet he paid the extra cash for the "paypal money back guarentee" ??
    I've never tried it, but I think Paypal will hold the funds in some type of escrow until you "approve" the item???

    Anyone ever try that? Or know how it works??

    He didn't pay the "money back guarentee" to Paypal but he did pay $10 to have them investigate the claim. The total price was $96 and I did use UPS. Paypal didn't request any information from me other than verification that I shipped it (which I provided). The next thing I know, $96 is getting sucked out of my Paypal account and they're asking me to add money to my account to get rid of the negative balance! I have appealed the claim but I doubt any good will come out of that, I'm the seller. I have pictures of the intake working on my V6 which I was going to use if necessary. He has not provided any pictures.
     
  5. He needed to file a claim with UPS since he was the receiver. But since paypal has apparently decided to give him his money back, I would think you have a basis to file a damage claim with UPS, of course you can't do that since he hasn't returned the intake. Either the buyer or Paypal should have to provide evidence of damages. The buyer hasn't informed you at all of the nature of the damage? Is he claiming damage due to shipping, or claiming it came damaged from you?

    He claims it came damaged from me. You can sort of see from the eBay picture that the switch is not cracked or leaking (where he claims it is broken). I believe he installed the intake and cross threaded the switch and cracked the aluminum. I've done it before, it doesn't take much. I can't believe Paypal would return his money without getting my side of the story. I'm going to file a claim through UPS because that's all I really have to go on now. That is, if I get my intake back!
     
  8. That's not how it works at our place of business. When we receive a damaged shipment from one of our vendors, we file the claim with UPS. We have the damaged stuff, if we call our vendor, they will tell us we have to file the claim. Maybe things work differently in a business setting, compared to non-commercial transactions.
     
  9. We don't usually get denied, but they take forever to pay. I've never had to personally file a claim for stuff I've bought myself.

    I filed my claim. Wish me luck. The buyer claims he is shippnig it back but I'm not holding my breath. UPS sent a link to a customer service survey when they replied to my claim. Maybe things are looking up!

    I think you're screwed. UPS will not pay the claim unless THEY damaged it during shipping and that YOU can prove it was properly pkg'ed.

    That is assuming the guy damaged it as you mentioned.

    And Paypal will have a tendency to screw the Seller, because they look at the Seller as a buisness. In other words, it will be up to YOU to prove the intake was damaged after it shipped. The constomer will get the benefit of the doubt from Paypal.:af:

    I've been considering dumping Paypal, it's just so convenient.:Do No: The most important thing you need to do open the paypal on a SEPARATE bank account (because they will FREEZE you account for 30 days if anyone pays you will a stolen CC)!:confused: :jd: :shock: :shock: :shock:

    If UPS did damage it and doesn't pay, take um to small claims court. Either way, your money will not show up anytime soon.:af:

    I'm pretty sure I'm screwed but I'm not one who gives up easily.

    I can prove it was properly packaged. I have Paypal on a seperate account. I already got burnt twice by stolen credit cards. I think I'm dropping Paypal and just going back to money orders and Western Union.

    Apparently I am not to well versed in the Paypal. How did this fellow take money back out of your account after he paid? You called it reversing. What stops anyone from doing this?

    I thought Paypal was supposed to be a surefire way to know you were getting paid for a item;looks like it is not.Looks like the old fashioned money order is maybe a safer way to get your money.I think you need to pursue getting your money back thur paypal [how can they take the buyers word over your word with no proof of wrongdoing on your part???] Also without the orginal shipping package and part you will not see any money from the shipping company for sure[and who can blame them because no proof of wrongdoing on thier part without package damage proof].Hope you get this resolved and your money back.

    Just like Dan mentioned earlier, Paypal looks at the Seller as a business, assuming a business has their own insurance protection, etc. The only business I have is when I mind my own business!:puzzled:

    This is the third time I was screwed through Paypal. The frist two times I share the blame because I shipped items to unconfirmed addresses outside of the USA. I didn't follow the rules so I lost. Since those transaction, I follow the rules to a "T". If you use Paypal, read the "Seller Protection Policy" under the security Center link. click here

    I followed the rules but still had the money reversed. I guess there is no "REAL" protection. I am refusing to use Paypal for any transaction over $25. I can't afford it. I'm going back to money orders for anything more.

    By the way David, I haven't gotten the intake back yet.

    I'm new to the Buick stuff BUT not to PAYPAL and EBAY. I've done almost $12,000 of business through paypal and about 70+ positives and 0 negatives.
    Paypal is now owned by Ebay. You need to tell paypal that the item was shipped in perfect used non broke condition. Buyer even left positive feed back on Aug 21st stating "VERY HELPFUL IN TRACKING PART WOULD BUY AGAIN A++++"
    Now here it is (X) weeks later and he is dissapointed. Also state that there was never a garuenty implied or expressed. Tell them that you had no control over how the part was installed or used and that it was in perfect working condition when on your vehicle and when shipped. Ask them,If was not in perfect condition, why was such a over whelming positive feedback given?
    Save all of your emails.
    Go here and read through it. See if all of the rules were followed.
    First, I noticed that the item wasn't covered under the "PayPal Buyer Protection" because your feed back is 97.5%. Per paypal, you must have:"At least 98% of your eBay feedback is positive"
    So the item wasn't covererd in that way.

    Thank you. I actually copied parts of your message and pasted it in to a message to Paypal. I haven't gotten anywhere before so we'll see if I get anywhere this time.

    By the way, since he has his money back and I've lost all communication with him and he won't return the product, wouldn't this be a legal matter now? Any legal experts on the board?

    UPS said they approved my claim but I have to provide proof of funds. No problem. I'd still like to burn this guy though.
