Does anyone now who ebay user kirschb from Varysburg NY is? He had a set of 70 to 72 rocker moldings on ebay. Well thought i got lucky. I won them for a bid of just $1.00. I emailed him 2 times for the shipping charge. After about 4 or 5 days he responds that there was a accident and they got bent so he dosent feel right for shipping them.. I think he just dosent want to let them go for $1.00. I emailed him back and said that since i'm the winning bidder to send me a pic. and that way i could decide if i still wanted them. Still no response from him And the heck of it is if i give him a bad feedback he most likely will give me one back. I have found people like this do that I don't know how to post the link but the # is 2486333510

He is a loser. States clearly on Ebay that it is contract to buy and sell any item. If I were you, I would leave feedback and clearly state "seller did not ship item as listed, made excuses" If you don't leave negative feedback, someone else will end up dealing with this loser!

You have to be brave and post NEG feedback. If not the looser will continue as he is. I have 3 neg's all from retalitory fedbacks I gave Neg too. These guys are going to be around unless someone nails them for neg feedback AND files a complaint with EBAY about them not honoring the sale end. The way I see it You listed it..... it sells...... you have to honor it like it or not!!

You can file a fraud report with ebay. They will then contact him threatening to suspend his ebay account if he doesn't follow through with the sale. It is against both the seller and bidder rules of ebay to back out on the sale if there was no reserve or if the reserve was met. You can also request arbitration through squaretrade. I would hold off on negative feedback until you exhaust your options through ebay, because 99% of the time you will get negative feedback in return.

The very first item i ever sold on ebay was a heart breaker. I got pennies compared to what it was worth. I feel it was because it was because of a por picture. I think thats why i was the only one that bid on these rocker moldings. The pic. was of poor quality

kevin, you can file a non performing seller report with ebay, but from what i read on the ebay boards, ebay wont really do much to the seller. it might get him motivated to do the right thing. he might send you a bent pair, or he may want $100.00 to ship them, some bull like that. it isnt right, but other than that, and fb, there isnt much that can be done.

the bad thing about fb is, it cant be edited, ( in some instances it can be removed ) and either party can post any lie. other v8 bb members have had sellers claim the item got damaged when it was likely that the seller just didnt want to sell the item for the bid amount. shame on those sellers. in nearly every case, fb can be posted well after 90 days if you have the item number and user ID of the person involved.

As stated above, you have exactly 90 days from the auction end to leave negative feedback. You can always wait until day 89 and leave feedback at the last minute. Chances are he won't have time to retaliate!! :Brow:

I went through this crap with some guy who had a bumper for our S10. I won the auction and the guy sent me some excuse about a coworker selling the bumper and that he would return my money when he got it from the coworker. It's been 4.5 months and still no money. Sqauretrade is pretty much worthless, unless it's a high value item. EBay pretty much blows too, with what they will/can do.

I called the guy last week and told him that I was coming to MN on business at the end of the month and would be paying him a visit, and we would take care of it man to man.

I left feedback saying exactly what happened, and out of the 3 auctions that he has put up since then, he hasn't gotten one bid for any of them

Kevin, I would get a e-mail from the guy on the damaged and print it for proof. Who knows it may be true, no way of knowing for sure. What was his feed back score? If you buy from a person with 100% he will do everything to make it right. But as I said before get something in writting to cover you self so the sell doesn't hit you with a non paying member. Here's an idea, we're all over the U.S., right. So we post to this board for someone close to where our non-performing seller or bidder lives.... Then they get paid a friendly, cordial visit to inquire as to why they don't want to complete the auction?:Brow:

"Hi, I'm a friend of (X), he said your rocker moldings were damaged and asked me to stop by and take a look at them so that you wouldn't have to go through the trouble of sending him photos... gosh, if you give me the money he gave you to ship them I'll even mail them for you."

    I would want a picture.
Then, since he could shoot a picture of some already damaged ones, I'd probably still tell him that I want them. That would force him to
    A) Send them hoping they weren't damaged
    B) Send them, but damage them to prove his point
    C) Find some others that are damaged that you wouldn't be able to tell the difference

Either way, it would make it difficult for him to resell them later if he doesn't have them.

The auction says they have the correct orange stripe (The red GS stripe!). Thus, it would be hard for him to do (C) above since he'd have to paint them to make them be what he represented in his auction.

Someone could always send him an email saying that they are looking for Skylark parts, including some more of those rocker panels, and request he list whatever else he has on ebay.

Even though he's not supposed to, he may offer them up for sale all of a sudden.
