I need your opinion please

    Joe I have sent you an email I would really like to put this behind us and move forward. Please send me a refund check for $390 or put a deposit down of $390 for a new cover at TA performance and I will pay the difference. Please respond to this thread that payment has been sent or the deposit has been made at TA performance so I can get confirmation on your intent. Thanks for your cooperation. Buickrat1

    X4. The though of not refunding the full amount would never even have crossed my mind.

    I am new to selling on this page but have been selling for years on Ebay. I sold a few things here and my price includes the shipping which includes the insurance in the FULL amount. Reasons for this is it is a responsibility of a seller to protect the buyers investment and it also protects me as a seller if the parts get lost or damaged by the shipper. Also if the package was shipped by Fedex, it's automatically insured for 100.00 for free.

    Just my opinion, if a seller sell's for a price shipped, seller better have insured it for the full amount. The buyer should not be out one cent for the sellers mistake.

    I am new to this site by a month and have never met anybody on here. I have only sold and not bought yet and actually had a member pay 20.00 more for a part I sold. I know, crazy. Great guy. When I sold parts though I thought what was I going to do if the item was lost in transit. My quick answer was refund the money because it is my responsibility to get it to the buyer and do insurance next time on larger items. If you buy something from Amazon they don't tell you they will only pay half if it gets to you. I understand that the buyer is always trying to get top dollar and the seller is trying to get it the cheapest possible but it is the sellers responsibility to get it to the customer. Both parties learned a lesson either way. Assuming only makes an.........well you know the rest.

    Like I eluded to,it would matter what the ad said,insured or not.And if insurance was turned down due to the buyers request,maybe to save money.That being said,I always insure anything I sell over $20.

    Although I do not agree with everyone here for various reasons I will refund Dave in full. It is really amazing to me the difference in thinking though.
    In regards to my Rocker story, when I never received them and later found out that they were lost it never crossed my mind to ask for a full refund.
    I knew it was a messed up situation and I knew the seller was very unhappy as well. I asked for half and Stu gave me half.

    FedEx said it takes 7 to 10 business days to close out a claim so I will send you a full refund thru paypal when this happens.
    I hope by some miracle they find the cover in the next couple of days, but it is highly unlikely.

    Joe - it is a hard pill to swallow but you are doing the right thing no matter what past experiences have been. your responsibility as the seller ends when the buyer receives the item in the condition it was represented in the sale.

    ... just a short story from an experience I had last year - I bought an Item and the seller was unable to package it so he took it to the UPS Packing store and had them package it and ship it, insuring it for the full value of the sale. It was a BIG box .. way oversized in length. Of course the box got mangled a bit and the item was damaged, but I was not there on delivery .. my wife accepted it. If i was there, I would have made the delivery person wait while I inspected it and probably would of denied acceptance.

    Here's where it gets good - because UPS Packaged it (which was a very poor job - several smaller boxes were overlapped and then just taped at the lap-seam providing no resistance to conpression) UPS was responsible and the claim was handled and paid very quickly. I had to provide pictures, verbal description of the damage ... etc as proof since no one was home for them to inspect. During the last conversation with the claims agent they told me that if the seller had packaged it the claim would have been denied.

    You never really know about these things. Another member sent me an item some time ago. It was a small item and he was giving it to me even though I offered to pay for it. Well, it didn't show up. I figured he just forgot, no big deal. Heck, I had even forgotten about, thern much to my surprise it showed up here over a year later. When I saw the return address I knew exactly what it was. It was sent via USPS rather than UPs but it was indeed postmarked over a year prior. Don't lose hope.

    Joe, you PAID a shipper to ship the part. Regardless of whether or not you paid for insurance, it was THEIR responsibility to ship the part. They did not ship the part. They LOST it in transit. They owe you the money. As soon as you handed them the money to ship it, it became their responsibility until it was delivered. Contact your local attorney general.

    Way to go BIGJOE, It sucks you lost money because of FED EX but you did the right thing and karma will reward you sometime for it. What goes around comes around. :TU::beers2:

    You sort of wonder if this car thing is really worth it when you lose out on money but like Tim said good karma will come back at some point.

    Thanks Joe for stepping up I really appreciate it. all the past issues with this sale is water under the bridge. I too had to step up a couple of week ago. I was selling a Tremec 3650 transmission for $550 on Ebay. And the guy who it the buy it now button also hit a shipping quote tab that ebay put in my ad. The shipping quote Ebay gave him was $74. I told the buyer there was know way I can get a carrier to ship a 140 lb transmission from Phoenix to Michigan for $74. I told they guy I could not ship it for the $74 he raised a fit so I honered the quote and it ended up costing me $290 to ship that transmission. I learned a very valuable lesson preview the ad very closley before hitting the submit button. Thanks again Dave
