Advise on reclaiming my car from bodyshop

    Well..... AL and I went up there to get the $$$. But he was not in.....he is (racing) at the Division I Bracket Finals in Delmar, DE.....where I will be hunting him on Sat. :blast:
    AL was right....we should have staged a call to the shop to see if he would be there.

    Just to be clear....the car was recovered. I am trying now to retrieve $500 that was "overpayment for work done" or not done in this case and $1000 in "damages". I have signed note saying he would pay me by 7-29-05.

    Believe me I am much more SICK of this than anyone here. Especially everytime I look at my GS and see how badly he abused it.

    If you have a signed note saying he would pay you by 7/29/05, then at this point ALL you should be doing is serving legal papers. Anything YOU do from this point on can only hurt you. Let the signed agreement do all the talking and make this thread go away. :error: :laugh:

    You are at a point where you need to get your money back altogether, I totally understand worrying about the worries of court,but with pictures, the years it spent at this shop unfinished. You've been wronged and even if yuo don't receive your total $5000.00 back, this guy obviously has enough dough to be racing a mopar on the weekends and is still jerking you around on a leash. I'm right there with you in not wanting to stir up ill feelings,there's just crazy people out there, but by god there's just no excuse for treating someone with this much disrespect both personally and also with regards to your personal and prized property. Id forget riding up there for a check, if anything ride up with a subpeona in hand and just walk away without a word said, (quickly and zigzagging if he has a gun)but that's how you'll be able to sleep at night knowing that he's been dealt a blow and won't dare do it to another person. Hope it works out for the best and dont worry the man above has a GM plate in his doorjamb, I just know it.-Chris

    Bruce, after careful thought I must also agree! You desirve more then the small amout offered to you but much more because of the damage and now the two checks he didn't sent and the "BS" he has been putting you threw! Because of the things he has done since you have a good case against him and I would be glad to help you persue this, AL.

    I would tend to agree, however he took 2 rolls of pics (like 50 pics) that he gave to me (said I could have them and that he had made doubles) documenting all the work that he did (supposedly over 100 hrs) and trying to show or trump up how "bad" the car was. Could hurt my case in court.

    He may be an A$$h(@% but he is no fool. I'd just like to get the $1500 and move on.....
    Time is money and I don't want to burn time just to prove a point or for minimal $$$ gain.
    However, if I don't get the $1500 I WILL take the next step.

    Despite the amount of photos he's takin that does not mean anything, and if those pictures are dated (i.e. 2-3 years AGO) And also the fact that you have Al as a witness to the conditions that the car sat in constantly you'd have a very good case. It's not so much to makea point as it is that he caused more damage to your vehicle to your car than it had going in. Interior had mold on it I think you said or the windows. You have pictures of how it sat in his yard and while it may not have been vandilized it was neglected while in his care. I'm not trying to drag Al in anymore than he would obviously want to, and its not a matter of who's right who's wrong or who can say he has the bigger kahonas, you've been wronged and you should seek restitution if not the full amount,but he should be held responsible for damaging your motor and having the body repaired correctly, not necessarily pay for paint but to have his work corrected at the very least. If you don't intend to follow through then post it here and let everybody here know to not bother posting anymore, you've set your mind on it and that is that and we'll all respect that.

    Makes sense Chris.....part of me wants justice but the other just wants it over and to move on.
    How bout a TV show: CAR COURT with "Judge Heckler" (I know it's Hecker but this sounds better). Could be hilarious.
    My sister is a TV producer maybe she could make it happen. :Brow:

    Dude - At least call a lawyer and ASK what your position and options are!!!

    Won't cost a thing to get a consultation. You need to find out where you really are with this bozo, instead of second-guessing him and yourself.

    That's your decision Bruce, I like the idea of getting at least a free consult,cant hurt to just ask. And depending who your sister works for you could start a car show that teaches people how to research a good shop and what to look for(like cars sitting out back without hoods :eek2: ) Sorry just had to get at least one jab in there. Well, you have your car back, and all your parts I assume! Like you're saying move on,cut your losses if you must but always remember what happened to you could happen to someone else. Hey if you think of it and this guy does screw you, post his shop name because I wouldn't want to go to his shop, and I live in PA!

    How smart is he? Maybe he only needs to think you'll take him to court, and think it will cost him more than $1,500 even if he wins.

    Well.....I got 2 checks friday from the guy....couldn't believe my eyes!!!!
    He says to cash one right away and the other on or after Nov 11th.

    It's not over till the check(s) clear though.......but this is progress.

    I guess my calling his shop 6 times a day starting last Monday got to him. Most bodyshops hate the phone. Causes too many interuptions. Even though he never picked up at least he probably stopped what he was doing to look at the caller ID.

    Maybe my somewhat blind faith in human nature will pay off in the end without getting out the big guns.....

    Both $750 checks have now cleared.
    So....this chapter is finally OVER!

    Now I just have to someday get the car finished..........

    Thanks for all the advice on this ordeal.

    Can't sing any praises for the jerk but I did finally get some of my money back.
    Good bodyshops in this area seem few and far between. They either screw you in $$$ or they screw you in the job. Or BOTH in this case!
    I believe I'll have to send the car out of the area to get er done.
