Beware 72 Stage1 convertible for sale in New York

    1972 Buick GS Stage1 convertible orange

    We negotiated a deal and had agreed on a number following new year. He told me that he had several people contact him about the car and I was taking too much time getting the information from Sloan museum (they Brittany was out for holiday weekend)

    So I offered to place a deposit to show my seriousness and hold car until the deal was concluded. He jumped at that so I sent him $500.00 via walmart service (cash). The deal fell apart yesterday when he insisted the only way he would transfer the car to Horseless carriage carriers was if I wired the remaineded 27.5K dollars FIRST and he had it in hand (cash).

    I disagreed and told him that the car would be verified as received by Horsless and I would complete the wire transfer. This went back and forth and finally I told him the deal was off. (yesterday).
    He has just sent me a txt message that he refuses to return my $500
    it was "non-refundable" The fact is it was never required or documented I por-offered to hold the car pending an agreement.

    Buyer beware I am out 500 but glad to not have to deal with this person anymore.

    I wouldn't ship a car until I was paid in full, and I would expect to be paid in full before the shipper was even arranged, and certainly before he arrived. It typically takes hours after a wire is sent to get your bank to tell you that it has been credited to your account. Expecting to not send the wire until the carrier has loaded the car in unrealistic in my mind.

    I HAVE INFORMED THE BUYER THAT IF HE WANTS, HE CAN HAVE JOHN CSORDAS WHO CHECKED OUT THE CAR WHICH CHECKED OUT PERFECTLY IN EVERY WAY, BRING THE MONEY. THEN I WILL GIVE KEYS AND TITLE IMMEDIATELY AND HAVE THE CAR SHIPPED TO HORSELESS CARRIAGE FOR HIM. IMMEDIATELY. SIMPLE.
    If you view johns contract, notice that he wants me to deliver the car to his shipper ON OR BEFORE 1/12/2018, HOWEVER, HE WILL INITIATE THE TRANSFER ON 1/12/2018.
    SO HE WANTS ME TO DELIVER THE CAR EVEN A DAY BEFORE HE INITIATES A TRANSFER AT WORST AND AT BEST THE DAY HE DOES. NO ! ONCE THE FUNDS HAVE CLEARED, I WILL DELIVER THE CAR IMMEDIATELY.
    I INFORMED THE BUYER THAT IF I TAKE 27,500 DOLLARS AND DONT DELIVER THE CAR, I WILL GO TO JAIL. THIS IS SO. YOU CANT TAKE THAT MUCH MONEY AND KEEP IT !
    I HAVE HELD THE CAR FOR HIM FOR ABOUT 3 WEEKS, DIDNT POST PICTURES ONLINE. WHICH I NOW AM. CHECK
    HEMMINGS. SENT HIM EVERY PICTURE HE WANTED AND EVERYTHING CHECKED OUT AS TRUE WITH JOHN CSORDAS INSPECTION. NO RUST ANYWHERE. PRODUCTION CODES RIGHT. NO RIPS ON INTERIOR. EVERYTHING I SAID WAS TRUE. WE AGREED ON A PRICE, DID A HANDSHAKE DEAL ON THE PHONE AND NOW, JUST BECAUSE HE WANTS ME TO DELIVER A CAR BEFORE FUNDS HAVE BEEN RECEIVED HE WANTS HIS MONEY BACK AFTER I HELD THE CAR FOR APPROX. 3 WEEKS FOR HIM.
    I TOLD HIM TO FLY OUT HERE AND DRIVE THE CAR HOME ! NOPE. DOESNT WANT TO.
    I TOLD HIM TO USE JOHN AS AN INTERMEDIARY. NOPE.
    DOES ANYONE HAVE A SOLUTION ??????? I JUST WANT TO MAKE SURE IM PAID BEFORE I DELIVER CAR. THAT'S ALL.

    I COULDNT AGREE MORE. CAN SOMEONE FIGURE OUT A WAY TO GUARANTEE MY MONEY AND HIS CAR ?! I OFFERED TO USE JOHN CSORDAS AS AN INTERMEDIARY IF HE IS WILLING TO DO SO.

    Agreed. The buyer has had the car inspected by an independent party, which has proven the car exists and is as represented. How is the seller to know that the money is real and exists?

    I wouldn't have loaded it w/o the wire having cleared. Standard practice afaik.

    I agree the car wouldn't go anywhere until I had cash in hand and would not spend that much on a car with out looking at it myself

    There are LEGITIMATE escrow companies like Escrow.com that are designed for these transactions. The buyer and seller agree to milestones that automatically release payment. The buyer has to deposit all the money so the seller knows that it's escrowed but they don't have to release all the payment until the car shows up - as described. And there is an arbitration process for disputes. Escrow is a normal part of home purchases -- why not cars!
